**11/03/10 Update - Urgent Action Needed! The Assembly Appropriations has scheduled a hearing on Bills A3273 and A3274 to fund Planned Parenthood/family planning clinics for Mon.Nov. 8, 2010 at 2 p.m. in Committee Room 11, 4th Floor of the State House Annex. These are the Assembly versions of the bills which were supposed to be heard at the October 7 Senate Budget Committee that was cancelled. See below for further details.
Bill information: Bill S2293/A3274 transfers $5M of unexpended balance from Purchase of Service for Inmates Incarcerated in County Penal Facilities account from the budget and appropriates that amount for Women's Health and family planning services. Bill S2294/A3273 requires the Department of Human Services to file a permanent waiver application to expand medicaid coverage to persons up to 200% of the poverty level. The bills will ensure that Planned Parenthood/family planning clinics get reimbursed 90% for every service they provide.
An important fact that the sponsors of these bills won't mention is that a U.S. Inspector General audit found that from 2001-2005, Planned Parenthood improperly billed all outpatient services to get the 90% reimbursement rate. The State had to reimburse the federal government a total of $3M for this billing error. Their arrogance knows no bounds.
These bills are on the fast track.

Pro-life Candidates Victorious in Pennsylvania
It came at 12:30 am on Nov. 3, the concession speech by Joe Sestak and the Victory speech of Pat Toomey, the new junior Senator from Pennsylvania. The Toomey-Sestak race was a nail-biter, the announcement coming after much earlier announcements of Tom Corbett's victory as Governor. In northeast PA, Lou Barletta won the Eleventh Congressional District seat over 26-year incumbent Paul Kanjorski and Tom Marino beating two-term Congressman Chris Carney in the Tenth Congressional district.
It was a clean sweep for pro-life Republicans!

Fox News Projects Dan Coats, Rand Paul to Win Senate Seats
Polls closed early in Kentucky and Indiana. Fox news projected just minutes ago that Rand Paul (R) would win the Senate seat in Kentucky. Paul has 56% against Conway with 44% with 18 % of the vote in. In Indiana, Dan Coats (R) is projected to win with 55% over Ellsworth(D) 39%.

Thoughts on Carney v. Marino Race by Jerry Birmelyn
I am sharing some of my thoughts on ... the 10th Congressional in northeast PA.
The incumbent, Chris Carney, is serving his second term, thanks to the poor behavior exhibited by his predecessor, Don Sherwood. He has since been clever enough to get re-elected in a GOP district by portraying himself as a "blue dog (conservative)" Democrat, while still having a voting record that is very liberal and in opposition to most 10th Congressional residents. Our local media doesn't challenge him at all and seldom reports on his voting record, so he has been able to deceive the public about the true nature of his votes.
Republican Tom Marino, answered a questionnaire from PA Family Institute,... but Carney did not.
I have also received an email from the American Family Association that lists 18 key votes by Carney, that you can see by going to:http://afaaction.net click on "Pennsylvania" and "House." There you will see in answers to issues .. that Carney has voted to restrict free speech in elections, expand federal gov. in education, support homosexuals serving in the military, Obamacare which includes federal funding for abortion among many other simply awful provisions and legislation that will lead to advocacy for same-sex marriages overseas. Not in this listing are his votes for the so-called "stimulus" legislation and Wall Street bailouts and many other similar huge spending bills that have caused our national debt to sky rocket out of control. So much for being a "blue dog."
His opponent, Tom Marino, is a former DA from Lycoming County and a former federal prosecutor. His positions are fairly conservative. I have attended meetings where he has reiterated these positions, so he is consistent in his public statements.
Tom's biggest challenge is to overcome his past association with a man, Lois DeNaples, who is quite controversial. Tom was employed by Mr. DeNaples after leaving the federal prosecutors office, to assist him with Mount Airy Lodge Casino. He has been attacked for that connection by Carney who is trying to make Marino "guilty by association." Carney has also made some charges about Marino being forced to leave office under a cloud of suspicion, but there is little evidence to support that claim and some evidence that it is really the opposite, that Marino served with distinction.
While I would not have gone to work for a man with the checkered past of Mr. DeNaples, especially in support of the gambling industry, I have to assess whether I want my Congressman to represent my values and what I think is best for the country. It is clear to me that Chris Carney has been supporting an agenda that is destroying the economic and moral fabric of our nation. He is a deceiver and lacks the character to defend his votes and, instead, has focused his campaign on attacking his opponent with peripheral issues.
When asked in a 2009 town hall meeting in Honesdale if he would vote for Obamacare if it allowed for federal funding of abortion, he stated that he would not. Yet, when presented with clear evidence (provided by several respected organizations) that this legislation did indeed provide for funding, he voted for it anyway and had the audacity to send out a press release stating the opposite:
"This bill also continues the longstanding ban on public funding for abortion, a factor that weighed heavily on my mind in recent days."
Yes, Tom Marino has some baggage ..., but when compared to the track record of Chris Carney and all the damage he has promoted, I see that my vote must be for Marino. Not only has Carney proven to be bad for this country, his re-election will be another vote for Pelosi and her ilk to continue their march towards more socialism and bigger government. Jerry Birmelin

He has since been clever enough to get re-elected in a GOP district by portraying himself as a "blue dog (conservative)" Democrat, while still having a voting record that is very liberal and in opposition to most 10th Congressional residents. Our local media doesn't challenge him at all and seldom reports on his voting record, so he has been able to deceive the public about the true nature of his votes.
Republican Tom Marino, answered a questionnaire from PA Family Institute,... but Carney did not.
I have also received an email from the American Family Association that lists 18 key votes by Carney, that you can see by going to:http://afaaction.net click on "Pennsylvania" and "House." There you will see in answers to issues .. that Carney has voted to restrict free speech in elections, expand federal gov. in education, support homosexuals serving in the military, Obamacare which includes federal funding for abortion among many other simply awful provisions and legislation that will lead to advocacy for same-sex marriages overseas. Not in this listing are his votes for the so-called "stimulus" legislation and Wall Street bailouts and many other similar huge spending bills that have caused our national debt to sky rocket out of control. So much for being a "blue dog."
His opponent, Tom Marino, is a former DA from Lycoming County and a former federal prosecutor. His positions are fairly conservative. I have attended meetings where he has reiterated these positions, so he is consistent in his public statements.
Tom's biggest challenge is to overcome his past association with a man, Lois DeNaples, who is quite controversial. Tom was employed by Mr. DeNaples after leaving the federal prosecutors office, to assist him with Mount Airy Lodge Casino. He has been attacked for that connection by Carney who is trying to make Marino "guilty by association." Carney has also made some charges about Marino being forced to leave office under a cloud of suspicion, but there is little evidence to support that claim and some evidence that it is really the opposite, that Marino served with distinction.
While I would not have gone to work for a man with the checkered past of Mr. DeNaples, especially in support of the gambling industry, I have to assess whether I want my Congressman to represent my values and what I think is best for the country. It is clear to me that Chris Carney has been supporting an agenda that is destroying the economic and moral fabric of our nation. He is a deceiver and lacks the character to defend his votes and, instead, has focused his campaign on attacking his opponent with peripheral issues.
When asked in a 2009 town hall meeting in Honesdale if he would vote for Obamacare if it allowed for federal funding of abortion, he stated that he would not. Yet, when presented with clear evidence (provided by several respected organizations) that this legislation did indeed provide for funding, he voted for it anyway and had the audacity to send out a press release stating the opposite:
"This bill also continues the longstanding ban on public funding for abortion, a factor that weighed heavily on my mind in recent days."
Yes, Tom Marino has some baggage ..., but when compared to the track record of Chris Carney and all the damage he has promoted, I see that my vote must be for Marino. Not only has Carney proven to be bad for this country, his re-election will be another vote for Pelosi and her ilk to continue their march towards more socialism and bigger government. Jerry Birmelin

Tom Corbett, Pennsylvania attorney general, and Republican
candidate for governor, has been a consistent pro-life advocate.
In a recent poll conducted by the PA Pro-Life Federation,
Corbett said he would support:
* Prohibiting the use of taxpayer dollars to fund elective abortions .
* Legislation providing women with the opportunity to view an
ultrasound of their preborn child before an abortion.
*Banning the use of state tax dollars for research which
destroys human embryos .
* Funding of Pregnancy Counseling Centers which provide
alternatives to abortion and do not counsel or refer for abortions.
His opponent, Democrat Dan Onorato, who has claimed to be
“personally pro-life,” has refused to respond to questions regarding
the above issues, in the PA Pro-Life Federation questionnaire.
He has also been quoted as saying that “Even if Roe v. Wade is
overturned, I will veto any attempt to change Pennsylvania’s law.”
(That law would allow abortions for up to 24 weeks of pregnancy).
Mr. Corbett has lauded the work of pro-life groups across the
state, and has consistently worked to preserve restrictions on abortions
in the state of Pennsylvania. He also stood up to Planned Parenthood
by supporting New Hampshire’s abortion control act before the
U.S. Supreme Court. By doing so, he ultimately protected
Pennsylvania’s Abortion Control Act by helping to preserve
restrictions on abortion nationwide.
Both candidates have promoted their own proposals for
healthcare reform in the state Mr. Corbett as attorney general,
joined Pennsylvania with 19 other states to file a lawsuit to stop
what is now called Obamacare, the sweeping health care reform
legislation that includes funding for abortion and raises concerns
about health care rationing. The states believe that the healthcare
reforms are unconstitutional.
In August, a federal judge allowed the suit to continue. The
federal court hearing began last month. While the Obama
Administration believes that states have no legal standing to bring
legal action against the federal government, attorneys general
for the 20 states believe the federal government is exceeding its
Constitutional authority by its mandate that all citizens have
health insurance or face a fine. The federal government’s
argument has been that the “individual mandate” is actually a
tax. Only taxpayers can argue the legality of a tax, they contend,
and even then only after the assessments take effect in 2015.
The administration also will cite its constitutional authority to
regulate interstate commerce, along with its responsibility to
provide for the public’s general welfare. As for healthcare, Mr.
Onorato has outlined several proposals, and while it does not go
into great detail under “Women’s Health,” it states that he “supports
state funding for comprehensive family planning services.”

Hazleton Mayor Lou Barletta has received the endorsement of the National Right to Life Committee Political Action Committee according to a Scranton Times article of 9/28/10. How radical is Rep. Joe Sestak's record on abortion? Sestak is radical enough to have earned the endorsement of the National Abortion Rights Action League (NARAL) in all of his political campaigns, as well as contributions from them. According to their mission statement, NARAL "uses the political process to guarantee….the full range of reproductive choices, including … choosing legal abortion."
Sestak received NARAL's endorsement and a $5,000 campaign contribution in the PA primary against Arlen Specter according to a May 12 th press release by Nancy Keenan, NARAL's president. Sestak said he was "greatful" for NARAL's support.

OBAMA SAYS RIGHTS STEM FROM THE STATE
Catholic League president Bill Donohue comments on President Obama's speech on October 18 at a fundraising dinner:
For the second time this fall, President Obama has quoted from the Declaration of Independence, omitting any reference to God. In Rockville, Maryland on Monday, he spoke of "inalienable rights," mentioning that "all men are created equal," but omitted what comes after this phrase: namely, he did not say "that they are endowed by their Creator" with these unalienable rights.
On September 15, after Obama omitted the same words before the Congressional Hispanic Caucus (there are four references to God in the Declaration), I faulted his speech writers but defended the president by saying he should "be given a pass." I can no longer do so: President Obama, it is painfully obvious, does not believe that individual rights are given to us by God.
The most dramatic historical achievement of the American Revolution was the insistence of the Founders that the state is not the source of our rights. What the state grants, it can take away. We saw this most strikingly under the Soviets: the Soviet Constitution was a marvelous tribute to human liberty, the only problem being that it made the state the origin of individual rights. By declaring God to be the origin of rights, the Founders deliberately awarded a subordinate role to government.
President Obama is the first president in American history not to acknowledge that all rights stem from God. Given that all prepared presidential speeches are written and vetted by many people, and that he was roundly criticized last month for this same infraction, it is only fair to conclude that this was not a mistake. This was deliberate.

There is currently a bill in the PA Legislature referred to as the Pre-Abortion Ultrasound Counseling Bill. This bill, if passed, would require a pregnant mother to view an ultrasound of her baby prior to a mandatory waiting period before she could kill her child.
Tom Corbett has promised that if this bill is passed and it comes to his desk, HE WILL SIGN IT. Dan Onorato has promised that if this bill is passed and it comes to his desk, HE WILL NOT SIGN IT.
So here is your scenario -
Let's suppose that for the sake of argument the election is held tomorrow, and you hold the deciding vote. Dan Onorato has 4,999,999 votes; Tom Corbett has 4,999,999 votes and there have been 100,000 votes cast for a write-in candidate. When you walk into the polling booth, how will you vote?
Now let's add one more "twist" to this scenario -Let's also suppose that we are assured that next year the House and Senate will pass the Pre-Abortion Ultrasound Counseling Law and this bill will go to the desk of our next governor. Again - how will you vote?
Finally, let's also suppose that if Tom Corbett is sitting in that chair and he signs it, that there will be a 17-year-old young lady named Ashley who will go for an abortion, but after viewing the ultrasound of her baby will change her mind and allow her baby - a little girl named Hannah - to live. Again - the bill will be signed by Tom Corbett; it will NOT be signed by Dan Onorato.
I know there are a handful of people who - for whatever reason - want to "teach the Republican party a lesson" by working to defeat Tom Corbett. If that is your position, I ask you to consider the very real impact that your vote could have on thousands of the most innocent lives - unborn children. While this scenario is hypothetical, it is not-at-all out of the realm of likely possibilities. And again, if your vote holds the power to decide - how will you vote? Are you willing to "teach the Republican party a lesson" if doing so would cost one little girl her life? How precious is life?

In its ruling, the Board stated, “Dr. Brigham has consistently and repetitively engaged in manipulative and deceptive behavior designed to circumvent the requirements of the board’s termination of pregnancy regulation and to eviscerate the protections that those regulations seek to afford to New Jersey patients.” The press release continues:

What is the effect of “Ella” on a teenage woman’s body?
The Family Research Council did a series on the abortifacient "ella". This post raises concerns about the effect on developing female teenagers and includes a video. From FRC: "The FDA issued no age limitations for ella. Dr. Harrison explains that no studies have been completed concerning the impact of ella on a developing female teenager. She explains that adolescent girls require estrogen and progesterone to properly develop, and therefore the impact of impeding this development could potentially be serious. For example, it is not known if a young woman might have difficulty in recovering ovarian activity once it has been intentionally blocked. The numbers are staggering and prove that Planned Parenthood is indeed all about abortion and admittedly the largest provider of abortions in the nation. In 2008, Planned Parenthood reported performing 324,008 abortions versus 2,405 adoption referrals and 9,433 prenatal care services. In 2007, they reported performing 305,310 abortions versus 4,912 adoption referrals and 10,914 prenatal clients. U.S. INSPECTOR GENERAL AUDIT REPORTS SHOW IMPROPER BILLING OF FAMILY PLANNING SERVICES IN NJ
Audits performed by the U.S. Inspector General for the Department of HHS uncovered a consistent problem with NJ family planning clinics improperly billing Medicaid for services that did not qualify as family planning. State officials were sent letters in July 2007, June 2008 and August 2008 notifying them of the problems and requesting action to correct the errors. The three reports covered the period from February 1, 2001 through January 31, 2005. The first audit identified that the state of New Jersey improperly received federal reimbursement at the enhanced 90% rate for 160,955 prescriptions drug claims that were billed as family planning, but did not qualify as family planning services. In the letter and accompanying report to Commissioner Velez, the Inspector General recommended that NJ repay $2,219,746 to the Federal Government.
The second audit by the U. S. Inspector General for the Department of HHS found that family planning clinics improperly received the enhanced 90% rate for outpatient services which did not qualify as family planning services. Of the 107 claims, 64 were for family planning services eligible for Federal Medicaid reimbursement at the 90 percent rate and 43 claims did not qualify as family planning services, and were therefore ineligible for Federal Medicaid reimbursement at the 90% rate. The report specifically cites Planned Parenthood Providers who told investigators that they billed all claims to Medicaid as �family planning� and �populated the family planning indicator field on Medicaid claims even though the service provided did not meet the criteria for 90 percent Federal funding.� As a result, a letter and the report was sent to the Commissioner of Human Services on June 17, 2008, by the Office of Inspector General recommending that the state refund $597,496 to the Federal Government and amend their procedures to prevent improper billing in the future.
The third audit found that the state of NJ received Federal Medicaid reimbursement for 111 of the 161 claims for inpatient services which were improperly billed as family planning at the enhanced 90 percent rate. As a result, the OIG recommended that the state of NJ reimburse $162,548 to the federal Government and determine the amount of federal Medicaid funds improperly reimbursed at the 90% rate for inpatient hospital services following the audit period and refund that amount to the Federal Government.
The facts cannot be denied. These audits show a systematic abuse of improper billing of Medicaid for family planning services to the federal government to obtain 90% reimbursement. Planned Parenthood has been cited specifically as one of the principal agents of these improper billing practices by the OIG. Page five of the 2008 report entitled, �Review of Outpatient Medicaid Claims Billed As Family Planning by New Jersey" says, �During our visits to family planning clinics throughout the State, many providers (especially Planned Parenthood providers) stated that they billed all claims to Medicaid as �family planning.� Therefore, officials at these clinics often populated the family planning indicator filed on Medicaid claims even though the service provided did not meet the criteria for 90 percent Federal funding. By populating this field, the MMIS designated the claim as eligible for 90 percent Federal funding.� The Office of Inspector General recommending that the state refund $597,496 to the Federal Government.
Planned Parenthood�s supporters not only want to use $7.5M in taxpayer dollars to fund these family planning clinics, they also want the state of NJ to permanently apply for a federal waiver to reimburse family planning clinics 90% for every Medicaid service they provide despite the clinics� history of improperly billing Medicaid and contributing to the nearly $3M in fees which had to be refunded to the Federal Government. Taxpayers should be outraged. These facts should give every legislator who voted for Bill S2139 a good reason to now oppose any misguided effort to override Governor Christie�s veto.

Court Prohibits Release of Referendum Petitions; Will Consider Harassment Exception
Today, a federal judge entered an order preventing Washington from releasing the names and addresses of individuals that signed a referendum petition to repeal Washington’s “everything but marriage” domestic partnership law. Several opposition groups threatened to post the names of the petition signers on the Internet in an effort to encourage uncomfortable conversations with petition signers. Similar efforts around the country have resulted in death threats, property damage, and other harassment directed at supporters of traditional marriage.
Protect Marriage Washington, the sponsor of the petition, obtained a ruling last year preventing Washington from releasing the names and addresses of the petition signers. Earlier this summer, the Supreme Court reversed that decision, and held that disclosure of referendum petitions generally does not violate the U.S. Constitution. However, the Supreme Court sent the case back to Washington to consider whether disclosure of the identities of the petition signers is unconstitutional in light of the widespread harassment directed at supporters of traditional marriage. Today’s ruling will allow the Court to consider Protect Marriage Washington’s case.
James Bopp, Jr., lead counsel for Protect Marriage Washington, is pleased with the Court’s ruling. “Supporters of traditional marriage have received death threats and have had their personal property destroyed after standing up to protect the institution of marriage. No one should have to endure the harassment that these individuals have endured in their personal and professional lives for standing up for what they believe in. I am confident that when the judge considers all of the evidence, copies of the petitions will not be released to the public.”
Today’s ruling will remain in effect until the Court can consider Protect Marriage Washington’s arguments that disclosure of the petitions will expose petition signers to a reasonable probability of threats, harassment, and reprisals. The Court has asked the parties to agree to an accelerated schedule. No further hearings in the case are scheduled at this time.
